DMCA Takedown Policy

KASTLR respects the intellectual property rights of others and expects its users and artists to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable South African copyright law, KASTLR will respond to valid notices of alleged copyright infringement.

What To Include in a Takedown Notice
To be valid, your DMCA notice must include all of the following:
- Your full legal name, address, telephone number, and email address.
- A description of the copyrighted work you claim has been infringed.
- The specific URL(s) on KASTLR where the allegedly infringing content is located.
- A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
- Your physical or electronic signature.
⚠ Notices that do not include all required elements may not be processed. Submitting a false or misleading DMCA notice may expose you to legal liability.
Our Response Process

Receipt — We acknowledge your notice within 2 business days.

Review — We assess the validity of the notice within 5 business days.

Action — If valid, the content is removed and the artist is notified.

Counter-notice — The artist may file a counter-notice within 10 business days.

Resolution — Content may be restored if a valid counter-notice is received and no legal action is filed.
Counter-Notice Process
If you are an artist who believes your content was removed as a result of a mistake or misidentification, you may submit a counter-notice to legal@kastlr.com including:
- Your full legal name, address, telephone number, and email address.
- Identification of the content that was removed and where it appeared on KASTLR.
- A statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification.
- A statement consenting to the jurisdiction of a South African court.
- Your physical or electronic signature.
Repeat Infringer Policy
KASTLR maintains a strict repeat infringer policy. Artists who receive three or more valid DMCA notices will have their accounts permanently terminated and all content removed from the platform. KASTLR reserves the right to terminate accounts at its sole discretion.
South African Copyright Law
KASTLR operates under the laws of the Republic of South Africa. In addition to the DMCA framework, KASTLR complies with the Copyright Act 98 of 1978 and the Electronic Communications and Transactions Act 25 of 2002. Rights holders may also pursue remedies under South African law independently of this process.
Good Faith Use
KASTLR respects fair use and fair dealing principles. We encourage rights holders to consider whether a use constitutes fair use or fair dealing before submitting a takedown notice. We will consider these principles when evaluating notices.
